Terms of Service

These terms govern your use of Tempered (the "Platform"), a decision-enrichment service operated by Tempered, a trading style of Your Systems Team Limited (Company No. 06798860). By creating an account or using the API, you agree to these terms.

1. The Service

The Platform provides AI-powered decision enrichment — multi-model analysis, dimensional scoring, preflight checks, and outstanding questions — so that you, the decision-maker, have more information and guidance before acting. You submit inputs via the web dashboard or API, the Platform evaluates them using one or more AI vendors, and returns structured enrichment data.

The Platform does not make decisions for you. It enriches your decision-making process with additional perspectives and analytical tooling. You remain responsible for all decisions made using the Platform's output.

2. Accounts and Access

• You must provide accurate registration information
• You are responsible for maintaining the security of your account credentials and API keys
• You must notify us immediately of any unauthorised access
• One person or organisation per account — sharing credentials is not permitted

3. Acceptable Use

You agree not to:

• Submit content that is illegal, harmful, or violates third-party rights
• Attempt to circumvent rate limits, quotas, or access controls
• Reverse-engineer the Platform or its AI evaluation methodology
• Use the Platform to generate content that could cause harm
• Resell or redistribute access to the Platform without a written agreement

4. Subscription and Billing

• Free tier: Subject to usage limits as published on the pricing page
• Paid tiers: Billed monthly or annually as selected at sign-up
• Upgrades take effect immediately; downgrades take effect at the next billing cycle
• We reserve the right to change pricing with 30 days' notice

5. Data Ownership

• Your data remains yours. Evaluation requests, results, and organisation data belong to you
• You grant us a limited licence to process your data solely for the purpose of providing the Platform
• We do not use your evaluation data to train AI models

6. Service Availability

• We target 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be communicated in advance where possible
• We are not liable for downtime caused by factors outside our control

7. Intellectual Property

• The Platform, its brand, trade marks, and documentation are our intellectual property
• Your evaluation data and analysis results are your intellectual property
• Feedback and suggestions you provide may be used to improve the Platform

8. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided "as is" without warranties of any kind
• We are not liable for decisions made based on the Platform's output
• Our total liability is limited to the fees you have paid in the preceding 12 months
• We are not liable for indirect, consequential, or incidental damages

9. Termination

• You may close your account at any time
• We may suspend or terminate accounts that violate these terms
• Upon termination, your data will be retained for 30 days then deleted (see Privacy Policy)
• Provisions that should survive termination (liability, IP, data rights) will survive

10. Changes to These Terms

We may update these terms with 30 days' notice. Continued use of the Platform after changes take effect constitutes acceptance. Material changes will be communicated via email.

11. Governing Law

These terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
